Building work for both commercial and residential purposes often involves disputes. Similarly, it can be vitally important to obtain competent legal advice on the meaning and effect of Building Contracts, both before signing and during construction. Our Firm has been involved in and advised upon:

Home Building

Actions in the District and Supreme Courts of New South Wales and the Consumer Trader and Tenancy Tribunal over many years. Our Firm has acted for Home Owners, Builders and Sub Contractors including claims for Insurance Payouts under the Home Owners Warranty Insurance Scheme and Claims for Defective Materials and Workmanship. The expertise gained allows us to give advice to Builders and Home Owners involved in Home Building Disputes.

Commercial and Building Contracts

The Firm has drafted and engaged in extensive negotiations in Commercial and Building Contracts for building projects as diverse as Backpacker Hostels, Home Unit Constructions, Town houses, commercial office suites and residential homes. Gibson Howlin Lawyers acts as Honorary Solicitors for the Landscape Contractor's Association of NSW.

Security of Payments

Legislation under the Building and Construction Industry Security of Payment Act (1999) (NSW) gives rise to payment disputes between Building Contractors and Owners. Gibson Howlin Lawyers will advise you on the quite strict time limitations that apply under that Legislation and can guide you through the process to Adjudication.

Building References and Mediations

The Supreme Court of New South Wales often refers Building Disputes to a Referee. There is also an increasing tendency of the Courts and Tribunal to compel Mediation as a preferred option to Court Hearings. Our experience in this area, coupled with our knowledge of the Law and ability to provide practical advice, can guide you to a successful outcome.
